Specific Issues Same-Sex Spouses May Face

While it is true that most family laws that apply to same-sex couples also apply to all couples, there are still some gray areas in the law. Legislators across the country are working on setting defined statutes for these areas of uncertainty. In the meantime, however, settling related disputes usually relies on an attorney’s expertise and intervention.

There are two main topics of potential concern for same-sex couples:

  1. Adoption - When a same-sex couple marries, one spouse may wish to adopt the children of the other, and vice versa. This was a tricky legal situation before, and so it is now, especially since courts may not find it clear as to which spouse has the right to adopt.
  2. Fathers’ rights - A whole section of family law is focused on protecting a fathers’ rights during a divorce, as history indicates that the mother would more often be seen in a favorable light. The legislation becomes unclear when there are two or no fathers in a marriage.
