Act 112: Section 5336 - Access to records

Section 5336 of Act 112 provides that a party with shared (or sole) legal custody of a child has the right to receive the childs' medical, religious and school records and also the address of the child and the other party.

Section 5336 is in accordance with prior custody practice, but it may be useful in prompting reluctant school districts and doctors to provide documentation to the "non-custodial" parent. Such reluctance has been a problem we have often encountered in our practice.

Section 5336 provides some exceptions to the right to receive such information in cases of abuse or under the Mental Health Procedures Act.
